This affirmation of regularity can be used by the plaintiff in an action for the foreclosure of real property in New York to request that the court appoint a referee to compute the amount due in the action. In a New York foreclosure action, computation of the amount owed may be done either by the court at inquest or, more commonly, by a referee appointed by the court. In either case, this includes a determination of the principal, interest, fees, charges, and attorney's fees (if provided for in the mortgage), as well as any credits due to the borrower. An affirmation from the plaintiff's attorney must be submitted to the court with the plaintiff's request that the court appoint a referee to make the computation.
